During a corporate internal investigation, employers often face pressure to cooperate with key stakeholders such as regulators, board members, and management whilst also safeguarding the rights of individuals implicated in potential misconduct.

Experience

We have been involved in the aftermath of some of the most high-profile corporate scandals of recent years. We have particular expertise in the financial services sector and have been involved in a variety of situations involving internal investigations and external regulatory agencies in the UK, Switzerland, the EU and the US.

We regularly conduct HR investigations for in-house HR teams, particularly where the matter involves high-stakes regulatory or whistleblowing considerations. There is usually a need for the investigation to be carried out by a separate firm to the firm that is advising the corporate upon the legal issue and we are often recommended by the corporate’s usual lawyers for this purpose.

Whilst corporates often use HR consultants for routine day-to-day investigations, complex or sensitive issues benefit from being managed by experienced solicitors. Where appropriate, corporate investigations conducted by lawyers may also be protected by legal privilege. Even when privilege doesn’t apply, our legal expertise adds significant value in analysing and assessing sensitive employee concerns.

We conduct thorough and impartial HR investigations into bullying, harassment, or discrimination allegations; grievances involving senior staff; disciplinary cases; whistleblowing disclosures; and concerns (raised by employees or trade unions) that employer policies may be discriminatory.
